These Terms & Conditions apply to your use of the Sam Joseph Chocolates website and to purchases made through our online shop.

These Terms & Conditions are governed by the laws of England and Wales.

We make and sell handmade chocolates, confectionery, baked goods, hot chocolate products, gift products and other food and drink items.
We take reasonable care to ensure that product descriptions, photographs, ingredients and other information displayed on our website are accurate.
However:
- colours shown on your screen may vary slightly from the actual product;
- handmade products may have slight variations in appearance;
- product availability may change;
- seasonal products may only be available for a limited time; and
- photographs may sometimes be for illustration purposes.
Any variation in the appearance of a handmade product will not affect your statutory rights where the product does not conform to the contract.
4. Product availability
All products are subject to availability.
Because many of our products are handmade in small batches, some products may occasionally sell out.
If you place an order for a product that subsequently becomes unavailable, we will contact you and, where appropriate, offer you an alternative product or a refund.
We may withdraw or discontinue products from sale at any time.
5. Allergens and ingredients
Our products contain various ingredients and may contain allergens.
Full allergen information is provided with our products and, where required, before you complete your purchase.
If you have a food allergy or intolerance, please check the ingredient and allergen information carefully before ordering.
If you are unsure whether a product is suitable for you, please contact us before placing your order.
Because our products are made in an environment where different ingredients are handled, we cannot guarantee that any product is completely free from traces of allergens unless this is specifically stated.
If you have a severe allergy, please contact us before ordering so that we can provide the most appropriate information available.
6. Prices
All prices displayed on our website are in pounds sterling (£).
Unless otherwise stated, prices include VAT where applicable.
Delivery charges are shown separately and will be displayed before you complete your purchase.
We take reasonable care to ensure that prices displayed on our website are correct.
If we discover an obvious pricing error, we may contact you before fulfilling the order.
If the correct price is higher than the price displayed, we will give you the option to continue with the order at the correct price or receive a full refund.
7. Promotions and discount codes
From time to time, we may offer discount codes, promotional offers, introductory discounts or other promotions.
Unless otherwise stated:
- promotional codes cannot be exchanged for cash;
- only one promotional code may be used per order;
- promotional codes may have expiry dates or other conditions;
- promotional offers cannot normally be applied retrospectively to previous orders; and
- some products or collections may be excluded from promotional offers.
Specific terms relating to an individual promotion will apply where stated.
We reserve the right to withdraw or amend a promotional offer where reasonably necessary, subject to applicable law and any rights you have already acquired.
8. Placing an order
When you place an order through our website, you are making an offer to purchase the products selected.
After placing your order, you will normally receive an email confirming that we have received your order.
This confirmation does not necessarily mean that your order has been accepted.
Your order is accepted when we confirm that the products have been dispatched, or otherwise confirm acceptance of your order.
We may refuse or cancel an order where there is a legitimate reason to do so, including where:
- a product is unavailable;
- there has been an obvious pricing or product description error;
- we suspect fraudulent or unauthorised activity;
- the delivery information is incomplete or incorrect;
- a technical error has affected the order; or
- we are unable to fulfil the order for a reason outside our reasonable control.
If we cancel an order after payment has been taken, we will provide an appropriate refund.

You are responsible for ensuring that the information you provide when placing an order is accurate and complete.

- telephone number, where requested; and
- payment information.
If you provide an incorrect delivery address, please contact us as soon as possible.
We will do our best to make changes before dispatch, but we cannot guarantee that changes can be made once an order has entered our processing or dispatch system.

We accept the payment methods displayed at checkout.

- PayPal;
- Apple Pay;
- Google Pay;
- Shop Pay;
- Klarna; and
- other payment methods made available through our payment providers.
Payment must be successfully authorised before an order can be processed.
Payment information is processed through our payment providers and we do not normally have access to your full payment card details.
11. Delivery
We currently deliver orders within the UK using Royal Mail, subject to the delivery options available at checkout.
Delivery charges and available services are displayed before you complete your order.
We aim to dispatch orders within the timeframe stated in our Shipping & Delivery Policy.
Delivery times are estimates rather than guaranteed delivery times unless we have specifically agreed otherwise with you.

Nothing in these Terms & Conditions removes or limits your statutory rights relating to delivery.
12. Warm weather
Chocolate can be affected by warm temperatures.
During particularly warm weather, we may delay dispatching an order where we reasonably believe that doing so will help protect the products from melting or damage during transit.
If an order is delayed for this reason, we will contact you where appropriate.
We recommend considering the weather conditions when ordering chocolates for a specific date.
13. Click & Collect
Where Click & Collect is available, the collection location and instructions will be shown at checkout.
You should wait until you receive confirmation that your order is ready before travelling to collect it.
Please bring your order confirmation or other relevant order information when collecting your order.
14. Returns, cancellations and refunds
Your statutory rights as a consumer are not affected by these Terms & Conditions.
Because our products are food items, certain cancellation rights may not apply to products that are perishable or liable to deteriorate or expire rapidly.
Other products may be subject to statutory cancellation rights when purchased online.
Where a cancellation right applies, we will provide the relevant information and refund in accordance with applicable consumer law.
Products that are faulty, damaged, incorrectly supplied or not as described remain subject to your statutory rights.

15. Faulty, damaged or incorrect products
We take care to ensure that your order is prepared and packed correctly.
If you receive a product that is:
- damaged;
- faulty;
- incorrect; or
- not as described,
please contact us as soon as reasonably possible.
Please provide your order number and, where appropriate, photographs of the product and packaging.
We will investigate the issue and provide the appropriate remedy in accordance with your statutory rights.
Depending on the circumstances, this may include a replacement, repair where applicable, refund or other appropriate remedy.
16. Subscriptions
If you purchase a subscription product through our website, additional subscription terms may apply.
The subscription details, price, frequency and cancellation arrangements will be provided as part of the subscription purchase process.

- have no cash value unless otherwise stated;

- cannot normally be transferred between customers;

We reserve the right to correct points balances where there has been an obvious error or fraudulent activity.
We may amend or discontinue the rewards programme where reasonably necessary, subject to any rights that have already accrued.
Any specific terms displayed within the rewards programme will apply in addition to these Terms & Conditions.
18. Gift cards and e-gift cards
Where gift cards or e-gift cards are available, their specific terms will be displayed at the time of purchase.
Gift cards may have restrictions on where and how they can be redeemed.
Please check the relevant gift card information before purchasing.
Gift cards cannot be exchanged for cash except where required by law.

All content on this website, including where applicable:
- photographs;
- product images;
- logos;
- branding;
- graphics;
- text;
- illustrations;
- designs;
- website layouts; and
- other original material
belongs to Sam Joseph Ltd or is used with permission.

The Sam Joseph Chocolates name, branding and associated intellectual property may not be used in a way that suggests an association or endorsement that does not exist.
20. Customer reviews, photographs and other content

- it does not infringe another person's rights;

Your statutory rights
Nothing in these Terms & Conditions is intended to take away or reduce any legal rights you have as a consumer.
Under the Consumer Rights Act 2015, goods supplied to consumers must, among other things, be of satisfactory quality, fit for purpose and as described.
Where you buy products online, additional rules may apply under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including information requirements and cancellation rights, subject to applicable exceptions.
If there is a conflict between these Terms & Conditions and a mandatory legal right that applies to you, the mandatory legal right will take precedence.
